Whitney National Bank wins domain name dispute

Whitney National Bank,a regional community banking institution,has recently won a domain name case through the National Arbitration Forum. The company,represented by Raymond G. Areaux submitted a complaint to the National Arbitration Forum,requesting the domain name whintneybank.com to be transferred from the respondent to the complainant.
Whitney National Bank owns many trademark registrations with the United Stated Patent and Trademark Office for the "Whitney Bank" mark .Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Respondent’s use of the disputed domain name to intentionally attract Internet users and profit through the receipt of click-through fees.  Respondent’s use of the disputed domain name attempts to capitalize on the confusing similarity between Respondent’s disputed domain name and Complainant’s mark and is evidence of bad faith."
"Respondent has engaged in the practice of typosquatting by intentionally misspelling Complainant’s WHITNEY BANK mark to misdirect Internet users.  The Panel finds that typosquatting is evidence of bad faith registration and use."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
