On their page,ICANN is trying to explain the well known case of the domain name YouTubeIslam.com .
"While ICANN does ultimately set the rules by which domain names are registered, it does not possess the power to overturn decisions that are made within the rules. Why? Because ICANN, through its bottom-up policy development, seeks to provide distributed, independent decision making that is placed in the hands most suited toward making these sorts of decisions."
The reason for bringing this case to our attention and for trying to explain us why ICANN is not the ultimate authority in the domain name industry was because a large number of people started to asked them about this case.
They went even further giving us some information about the domain name case submitted to the National Arbitration Forum.
It seems that Google owns the "Youtube" mark,registered with the United States Patent and Trademark Office and that IAI ,the respondent in this case infringed its trademark.
Moreover,the domain name resolves to a website where the respondent allows users to upload videos and information about the Islamic faith.
Because the National Arbitration Forum has not received an answer and because Google tried to demonstrate all three elements to obtain the transfer of the disputed domain name,the Panel decided YouTubeIslam.com to stay at Google.
