Victoria's Secret has recently won the victoriassecretzone.info domain name in Arbitration.
The company submitted a complaint to the National Arbitration
Forum,requesting the disputed domain name to be transferred from the
respondent to the complainant.
Victoria's Secret owns many registered
trademarks for the "Victoria's Secret" mark.Therefore,they contended in
the complaint that the disputed domain name is confusingly similar to
its trademark.
Moreover,they contended that the respondent registered
and used the domain name in bad faith .
"Respondent use of
confusingly similar domain names to attract Internet users seeking
Complainant’s services and then diverting them to third-party competing
websites is evidence of bad faith registration and use ."
Because the
respondent failed to submit a response in this proceeding and because
the complainant managed to demonstrate all the elements needed,the Panel
ordered that the victoriassecretzone.info domain name be transferred
from respondent to complainant.
