The well known company,Victoria's Secret,which is an American retailer of women's wear,lingerie,shoes and beauty products, won the domain name victoriassecretpromotion.com through arbitration .
In the complaint submitted to the National Arbitration Forum,the company claims rights over the disputed domain name,saying that victoriassecretpromotion.com is confusingly similar to their mark and also,that the respondent registered and used it in bad faith.
The company represented by Melise R. Blakeslee has submitted evidence of federal trademark registrations for the VICTORIA’S SECRET mark with the United States Patent and Trademark Office.
In the application they contended that the respondent registered and used the domain name in bad faith .
"Respondent has used the <victoriassecretpromotion.com> domain name (registered February 19, 2009) to divert Internet customers from Complainant’s website to Complainant’s competitors."
"Respondent gained commercially from this diversion, through the click-through fees Respondent was collecting from Complainant’s competitors. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided victoriassecretpromotion.com to be transfer from the respondent to the complainant .
