Victoria's Secret has recently won the victoriassecretbrazil.com domain name in Arbitration.
The company submitted a complaint to the National Arbitration Forum,requesting the disputed domain name to be transferred from the respondent to the complainant.
Victoria's Secret owns many registered trademarks for the "Victoria's Secret" mark.Therefore,they contended in the complaint that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith .
"Respondent uses the <victoriassecretbrazil.com> domain name to divert Internet users seeking Complainant’s products to Respondent’s website. "
"Respondent is using the disputed domain name to offer counterfeit versions of Complainant’s goods. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the victoriassecretbrazil.com domain name be transferred from respondent to complainant.
