The well known company,Victoria's Secret,which is an American retailer of women's wear,lingerie,shoes and beauty products, won the domain name www-victoriassecretgift.com through arbitration.
In the complaint submitted to the National Arbitration Forum,the company claims rights over the disputed domain name,saying that www-victoriassecretgift.com is confusingly similar to their mark and also,that the respondent registered and used it in bad faith.
The company represented by Melise R. Blakeslee has submitted evidence of federal trademark registrations for theVICTORIA’S SECRET mark with the USPTO.
In the application they contended that the respondent registered and used the domain name in bad faith .
"Respondent’s use of the <www-victoriassecretgift.com> domain name to intentionally cause a likelihood of confusion between the disputed domain name and Complainant’s mark to commercially benefit by offering Internet users gift cards in exchange for personal information and promoting goods unrelated to Complainant is evidence of bad faith."
Because ,the respondent failed to submit a response and because the complainant managed to demonstrate all the elements needed ,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
