Travelocity.com wins domain name case

Travelocity ,an online travel agency has recently submitted a complaint to the National Arbitration Forum ,requesting the domain names tavelocity.com and travalocity.com to be transferred from the respondent to the complainant.

The online agency has a registered "Travelocity" mark with the United States Patent and Trademark Office .Therefore,they contended in the application that the respondent registered  domain names confusingly similar to its trademark .
Moreover,they accuse the respondent that he had registered and used the disputed domain names in bad faith .
"The disputed domain names each resolve to websites displaying advertisements for Complainant’s competitors, which disrupts Complainant’s business by misleading Internet users searching for Complainant’s travel services.  Thus, the Panel finds Respondent has engaged in bad faith registration and use of the disputed domain names."
"The Panel finds that Respondent’s use of the confusingly similar disputed domain names is an attempt by Respondent to profit through the receipt of referral or click-through fees by attempting to mislead Internet users as to Complainant’s affiliation with the website.  Therefore, the Panel finds Respondent has engaged in bad faith registration and use."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the two domain names to be transferred from the respondent tho the complainant.
