The musician Larry Graham wins domain name case

Larry Graham,an American baritone singer, musician, songwriter, and record producer submitted a complaint to the National Arbitration Forum requesting the domain name larrygraham.com to be transferred to him .

In the complaint  he says that " he has a common law trademark in his name, Larry Graham, as he is an internationally-known musician who has recorded, performed and sold albums, CDs, videos and concert tickets under his name for over four decades."
He also added to the complaint that the respondent,used the domain name in bad faith.Not only had he used the domain name for a website with pay-per-click news,but he also tried to sell the disputed domain name to complainant for $10,000 .
On the other hand,the respondent stated that he didn't registered or used the domain name in bad faith.he said that the website to which larrygraham.com domain name resolved to contained indeed PPC links,but those links were posted by the registrar .
The Panel decided not only the domain name is confusingly similar to the complainant name,but also the disputed domain name was registered and used in bad faith.
Therefore,it was decided the disputed domain name , larrygraham.com ,to be transferred from the respondent to the complainant.
