The American Automobile Association gets hands on two domain names

E-mail Print

The American Automobile Association, also known as AAA has recently won aaabargains.com andaaadiscountmart.com through arbitration.

The American Automobile Association registered the "AAA" mark with the United States Patent and Trademark Office. Therefore they are accusing the respondent that they have registered a domain name confusingly similar to its trademark.
Moreover, the respondent ,Vincent Nedjetti is accused of registering and using the domain name in bad faith.
"Respondent’s registration and use of the <aaabargains.com> and <aaadiscountmart.com> domain names to operate a click-through website in direct competition with Complainant constitutes a disruption of Complainant’s business and constitutes bad faith registration and use ."
"Respondent’s use of the confusingly similar disputed domain names in order to intentionally attract Internet users to its website by creating a strong likelihood of confusion with Complainant’s AAA mark is further evidence of bad faith."
Because, the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed, the Panel decided the two disputed domain names to be transferred from the respondent to the complainant.
