State Farm Mutual Automobile Insurance Company,a mutual insurance firm, has recently won the statefarm2save.com domain name in arbitration .
The mutual insurance firm submitted a complaint to the National Arbitration Forum,requesting the statefarm2save.com domain name to be transferred from the respondent to the complainant. The complainant owns a service mark registration for the "State Farm" mark with the United States Patent and Trademark Office .Therefore they contended in the complaint that the disputed domain names are confusingly similar to its trademark.
Moreover,they said the disputed domain names were registered and used in bad faith.
"Respondent’s disputed domain name resolves to a website that offers links to third-party websites unrelated to Complainant’s services. Complainant argues that Respondent likely profits from the confusing similarity between its disputed domain name and Complainant’s mark by receiving click-through fees from the displayed links. "
Because the complainant managed to demonstrate all the elements needed and because the respondent failed to submit a response in this case,the Panel ordered the disputed domain name be transferred from the respondent to the complainant .
