State Farm Mutual Automobile Insurance Company,a mutual insurance firm, has recently won another domain name case.
Complainant submitted a complaint to the National Arbitration Forum,requesting the statefarmlive.com domain name to be transferred from the respondent to the complainant.
The complainant owns a service mark registration for the "State Farm" mark with the United States Patent and Trademark Office .Therefore they contended in the complaint that the respondent registered a domain name confusingly similar to its trademark .
Moreover,they said the disputed domain name was registered and used in bad faith.
"Respondent’s confusingly similar <statefarmlive.com> domain name creates a likelihood of confusion as to Complainant’s affiliation with the disputed domain name."
"Respondent is commercially gaining from this likelihood of confusion through its presumed receipt of click-through fees, which constitutes bad faith registration and use."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
