Salesforce.com loses dispute over Forces.com domain name

An arbitrator with the National Arbitration Forum has awarded Forces.com domain name to John Berryhill.SalesForce.com submitted a complaint with the National Arbitration Forum on November 2,2011,asserting legal rights over the disputed domain name . SalesForce.com contended in the complaint that Forces.com domain name is confusingly similar to its "Force" and "Force.com " marks .Therefore,SalesForce contended that the respondent is guilty of typosquatting.Moreover,the company contended that the respondent ,John Berryhill ,registered and used the domain name in bad faith :

"John Berryhill had actual or constructive knowledge of Complainant’s rights before the domain name was registered.  Moreover, Complainant contends that Respondent is a “professional domain name seller,” has exhibited a pattern of infringement on the trademark rights of others, and has offered to sell the domain name to Complainant. "

On the other hand,JOhn Berryhill contended that Salesforce.com's mark are neither famous nor distinctive and that the domain at issue in this case is a common dictionary word .

The Panel ordered the disputed domain name to remain with John Berryhill .
