Royal Bank of Scotland wins domain name case

The Royal Bank of Scotland Group,a British banking and insurance holding company has recently won a domain name dispute .The complainant,represented in this case by James A. Thomas,submitted a complaint to the National Arbitration Forum,requesting the disputed domain name,rbscout.com to be transferred from the respondent to the complainant. The financial services company owns many trademark registrations for the  "RBS" mark.Therefore,they contended that the domain name is confusingly similar to its trademark.
Moreover,the complainant contended that the respondent registered and used the domain name in bad faith.
"Respondent uses Complainant’s RBS mark in the <rbscout.com> domain name to attract Internet users seeking Complainant’s financial services and products to Respondent’s site.  Complainant asserts that Respondent’s site is designed with the goal only of generating profit for Respondent via click-through fees.  By displaying links relating to Complainant’s line of business in the financial services industry, Respondent increases the likelihood that Internet users will be confused about an affiliation between Respondent’s website and Complainant."
Because the complainant managed to demonstrate all the elements needed,and because the respondent failed to submit a response in this proceeding,the Panel ordered that the disputed domain name be transferred from the respondent to the complainant.
