Red Bull,the Austrian company which sells the Red Bull energy drink,has recently won a domain name case .
The company filed a complaint with the WIPO Arbitration and Mediation Center ,requesting redbullcompetition.com domain name to be transferred from the respondent to the complainant.
Also,the complainant submitted evidence of trademark registrations for the RED BULL term.
Therefore,in the complaint they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain names in bad faith.
"In light of the reputation of the RED BULL trademark, the reproduction by Respondent of that trademark in its entirety, and the combination of that trademark with the generic term “competition”, it is clear that Respondent in all likelihood knew of the existence of Complainant’s trademark and of its reputation worldwide."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
