Prada,the famous fashion house has recently won a domain name case covering a domain name against Paul C. Szigety .
The company submitted a complaint to the National Arbitration Forum,asserting legal rights over the disputed domain name ,Prada.us .
Prada owns numerous trademark registrations of its "Prada" mark with the United States Patent and Trademark Office.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used Prada.us domain name in bad faith .
"Respondent uses the disputed domain name to operate a website which displays Complainant’s PRADA mark and offers for sale counterfeit goods of Complainant’s luxury brand items either directly or through third-party links. Internet users intending to purchase Complainant’s products may find Respondent’s website and purchase similar products from Respondent or a third-party competitor as a result."
The respondent failed to submit a response in this proceeding .
The Panel ordered the disputed domain name be transferred from the respondent to the complainant .
