NYSE Group,submitted a complaint to the National Arbitration Forum,requesting the domain name,nyseconnect.com, to be transferred to them .
Moreover,the complainant contended that the domain name was registered and used in bad faith .
"Complainant contends that Respondent has failed to make active use of the disputed domain name, and that this failure is evidence of Respondent’s registration and use of the disputed domain name (initial registration: January 5, 2000) in bad faith pursuant to Policy ¶ 4(a)(iii)). The Panel agrees with Complainant’s contention and finds that Respondent’s failure to make active use of the disputed domain name indicates that Respondent registered and is using the disputed domain name in bad faith pursuant to Policy ¶ 4(a)(iii)). "
Because the respondent failed to submit a response in this proceeding and because the complainant manage to demonstrate all the elements required ,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
