Nokia wins booklet-nokia.com domain name in Arbitration

Nokia Corporation,a multinational communications corporation,filed a complaint with the WIPO Arbitration and Mediation Center ,requesting the booklet-nokia.com domain name to be transferred from the respondent to the complainant. Nokia owns many trademark registrations for the "Nokia" mark all over the world.Moreover,the company also owns the registered mark "Bokklet".
Therefore,they contended in the complaint that the domain name is confusingly similar to its trademark,and that the respondent registered and used the domain name in bad faith .
"Respondent registered the Domain Name in bad faith, with full knowledge that including the Complainant’s famous trademark would likely cause an Internet user visiting the website to which the Domain Name redirects to believe that it is somehow sponsored by, associated with or affiliated with Nokia. The Respondent is intentionally attempting to attract Internet users to its website for commercial gain by creating a likelihood of confusion among Internet users between the Complainant’s famous trademarks and the source, sponsorship, affiliation or endorsement of the Respondent’s website."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered that the disputed domain name be transferred from the respondent to the complainant.
