With the opening ceremonies of the 2008 Beijing Summer Olympics on August 8th, all eyes have been on China this summer. Every two years, the world unites under the Olympics’ three pillars of sport, environment and culture with the greater world ideals of peace, unity and interconnectedness. It shouldn’t just take the Olympics or a World Cup to feel integrated in our global community. The World Wide Web and the ever-expanding "domainosphere", with 280 Top-Level Domains (TLDs) and over 103 million domains in existence, have helped make the world a smaller place. In fact, Google recently released that the number of sites on the internet has topped one trillion, a stark jump from a mere 26 million only 10 years ago.

The plaintiff, Utah Lighthouse Ministry, is a non-profit organization that scrutinizes several religious institutions through its official website. The defendant, the Foundation for Apologetic Information and Research, is a volunteer organization created with the purpose of defending criticism against a particular religious institution. The defendant, in an effort to attack the plaintiff’s criticism, registered several domain names containing the terms “Utah” and “Lighthouse” as used in the plaintiff’s name in addition to creating a parody website that mocked the plaintiff’s official webpage. The plaintiff, in discovering the parody site, sued the defendant for trademark infringement as well as cybersquatting. By Frank Baird III, Legal Team

Several acts of the British Parliament hold that intellectual property complaints may be “unjustified threats,” entitling the defendant in an infringement case to bring an action for damages against the plaintiff for any losses suffered as a consequence of the threat of litigation. Section 70 of the Patents Act 1977 provides that an allegation of infringement is unjustified unless the one making the threat can prove at trial that their intellectual property right is actually being infringed. The recent case of LB Europe Limited provides an example of Section 70 in action. Smurfit Bag In A Box threatened a customer of LB Europe with a lawsuit: if the customer sold LB Europe’s dispensing tap, Smurfit would sue the customer for patent infringement. As countries like the US and the UK continue to suffer economic set-backs, the domain industry remains a steady and reliable investment in these markets. In fact, domain names that relate to the state of these economies are thriving. Sedo’s recent domain sales included onlinesavingsaccount.com (9,988 USD) and petrolprices.co.uk (8600 GBP). So how can your business utilize the secondary domain market to escape and even benefit from the current economic crisis? Below are a few things to keep mind as you move forward with domain investing. PPC Proves to be Recession-Proof While pressure to increase efficiency and curb spending is top priority in many businesses right now, savvy marketers continue to invest more money into their online resources, especially with Pay-Per-Click (PPC) advertising. Forbes has an interesting article on the domain name aftermarket, what they call "domain flipping", quoting Domain Name Journal's Ron Jackson saying domain name sales in the first half of 2008 reached $68 million, up about 12% from the same period last year. Jackson estimates that entire aftermarket did $700 million in sales in 2006. Since then, sales likely have topped $1 billion. You are not authorised to view this resource. You need to login.
