NBC Universal,a media and entertainment company has recently won a domain name through arbitration.
The company filed a complaint with the WIPO Arbitration and Mediation Center,requesting the domain name nbcatlanta.com to be transferred from the respondent to the complainant.
Complainant owns many trademark registrations in the United States for the "NBC" mark.Therefore,in the complaint ,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Complainant alleges bad faith registration by the fact that Respondent acquired the domain name with full knowledge of the NBC mark. As Respondent resides in the United States, it would be difficult to believe he did not know the NBC name when acquiring the domain name."
On the other hand,the respondent,Roger Pelfrey said that nbcatlanta.com was related to its trash dumpster business National Bins and Containers of Atlanta.He added that he never intended to sell the domain name.
All in all,because the complainant managed to demonstrate all the elements ,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
