National Westminster Bank scores victory in domain name case

E-mail Print

An arbitrator with National Arbitration Forum has awarded American International Group the natwestinternal.com domain name. Also known by its trading name,NatWest, the bank was represented in this case by James A. Thomas.A complainant was submitted to the National Arbitration Forum,in which they requested the domain name natwestinternal.com to be transferred from the respondent to the comaplainant.
Complainant, owns many trademark registrations for the "Natwest" mark with the United States Patent and Trademark Office and the United Kingdom Intellectual Property Office.
Therefore, they contended in the complaint that the disputed domain name is confusingly similar to tis trademark.
Moreover, they contended that the respondent , Nathaniel Westerly, registered and used the domain name in bad faith.
"Respondent’s <natwestinternal.com> domain name resolves to a website featuring hyperlinks to financial products and services that compete with Complainant.  Internet users may purchase these financial products and services from one of Complainant’s competitors instead of from Complainant because of Respondent’s use of the confusingly similar disputed domain name."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed, the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
