An arbitration with National Arbitration Froum has awarded the domain name MSNblocato.com to Microsoft.All started when Microsoft submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain name.
The company owns many trademark registrations with the United States Patent and Trademark Office for its "MSN" mark .Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent formerly used the <msnbloccato.com> domain name to resolve to a website that was a part of a phishing scheme. Internet users, upon accessing the website, were asked for their e-mail addresses and passwords. The website resolving from the disputed domain name purportedly would use this information to determine who had blocked their e-mails. "
Respondent failed to submit a response in this proceeding.Therefore,the Panel ordered the disputed domain name be transferred from the respondent to the complainant.
