Microsoft,the United States-based multinational computer technology corporation has recently won a domain name case covering four domain names against Robert Jones .
The four domain names are : livexboxdeals.com, windowsvistabasic.com, xbox360hits.com and xboxhits.com .
The company submitted a complaint with the National Arbitration Forum,asserting legal rights over the disputed domain names .
Microsoft owns many trademark registrations for the "XBox" mark as well for the "Windows Vista" mark.Therefore,they contended that the disputed domain name is confusingly similar to its trademark .
Moreover,Microsoft contended that the respondent registered and used the disputed domain name in bad faith :
"Respondent receives click-through fees from the aforementioned third-party links on the resolving websites. Internet users searching for Complainant online may find Respondent’s website instead due to the confusingly similar domain name. Users may then become confused as to Complainant’s sponsorship of, or affiliation with, the resolving site and the third-party links displayed. "
Because Microsoft managed to demonstrate all the elements needed,the Panel ordered that the domain names be transferred from the respondent to the complainant.
