Microsoft filed a complaint with the National Arbitration Forum,asserting that the confusingly similar domain names has been registered and used bad in faith,that August Communication's conduct was unethical and that it would harm both Microsoft as well as its users .
The company owns many trademark registration for the "Microsoft" mark.Therefore ,it is more than obvious that the disputed domain names are confusingly similar to its trademark .
The respondent registered the eight domain names on September 12,2010.
Microsoft has also offered evidence that Respondent’s websites contain third-party links to unrelated companies, for which Respondent receives click-through or affiliate fees. Complainant argues that Respondent’s use of Complainant’s marks and logos on its websites in order to commercially profit is evidence of bad faith registration and use.
The National Arbitration Forum ruled in favor of Microsoft and ordered that it be awarded ownership of the disputed domain names .
