An arbitrator with the National Arbitration Forum has awarded gamekinect.com, gameskinect.com and kinectpro.com domain names to Microsoft .Microsoft was represented by Molly Buck Richard in this case .
All started when Microsoft submitted a complaint to the National Arbitration Forum,asserting legal rights over the disputed domain names.
The company provided the Panel with evidence of its registration of the "Kinect" mark .Moreover,Microsoft owns many trademark registration for the "Kinect" mark all over the world.Therefore,they contended that the disputed domain names are confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain names in bad faith .
"Respondent registered and is using the disputed domain names in bad faith because of the commercial gain Respondent receives from the sites. "
"Respondent’s offer to sell the disputed domain names is evidence of bad faith registration and use by respondent."
The Panel ordered the disputed domain names be transferred from the respondent to the complainant.
