An arbitrator with National Arbitration Forum has awarded 18 domain names to Microsoft.A complainant was submitted to the National Arbitration Forum,in which Microsoft requested the eighteen domain names to be transferred from the respondent to the complainant .
The eighteen domain names are : wirelessxbox.com, xbox2accessory.com, xbox-360-accessories.com, xbox360-accessories.com, xbox-360-accessory.com, xbox360-accessory.com, xbox360gamerentals.com, xbox360gamesreviews.com, xboxwirelessheadset.com, x-box-accessories.com, xboxaccessories.net, xboxaccessory.com, xboxadapters.com, xboxmemory.com, xboxwirelessadapters.com, xboxwirelesscontrollers.com, xboxwirelessheadsets.com, xbox360wirelesscontrollers.com .
Microsoft owns many trademark registrations with the United States Patent and Trademark Office for the "XBOX" mark.
Therefore,they contended that the disputed domain names are confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain names in bad faith.
"Respondent is using the domain names to display pay-per-click advertisements for goods and services identical or closely related to those of Complainant and its competitors in the video game industry."
"Respondent uses the disputed domain names to attract Complainant’s prospective customers to its own websites, thus to profit from the receipt of pay-per-click fees associated with the displayed third-party links."
Because the complainant managed to demonstrate all the elements needed and because the respondent failed to submit a response in this proceeding,the Panel ordered that the domain names be transferred from the respondent to the complainant.
