Microsoft,the company who sells video game entertainment systems,software and accessories under the "Xbox" brand,submitted a complaint to the National Arbitration Forum ,requesting the transfer of xboxatomic.com.
Moreover,they say that "the website to which the disputed domain name resolves “features pornographic content that glorifies rape and incest” and includes revenue-generating links to other similar sites."
The respondent said that “As a legal owner of XBOX360 game console I have a right to register domain name containing word ‘xbox’. I purchased my XBOX 360 fairly and legal why shouldn’t I register a domain name containing ‘xbox’?” .
Even though the respondent said he owned an XBOX console,he didn't offered any evidence that he really owns one.
Being confusingly similar to Microsoft's mark,and being registered and used in bad faith,the Panel decided the disputed domain name ,xboxatomic.com, to be transferred from the respondent to the complainant.
