An arbitrator with National Arbitration Forum has awarded the domain name ProdigyMSN.net to Microsoft.All started when Microsoft submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain name.
The company owns many trademark registrations with the United States Patent and Trademark Office for its "MSN" mark .Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent displays Complainant’s MSN mark and logo at the <prodigymsn.net> domain name in order to pass itself off as Complainant and thus create confusion among Internet users. Respondent presumably uses Complainant’s mark and logo in this way for some commercial gain."
Respondent failed to submit a response in this proceeding.Therefore,the Panel ordered the disputed domain name be transferred from the respondent to the complainant.
