An arbitrator with National Arbitration Forum has awarded the domain names msnfriend.com,msnhack.com,msn-info.com, and msntour.com to Microsoft.
All started when Microsoft submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain names. The company owns many trademark registrations with the United States Patent and Trademark Office for its "MSN" mark .Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent registered the disputed domain names after Complainant acquired rights in the MSN mark through its registrations of the mark with the USPTO and the KIPO. "
"Respondent’s offer to sell the disputed domain names for more than its out-of-pocket costs indicates registration and use in bad faith"
The Panel ordered the disputed domain nameS be transferred from the respondent to the complainant.
