Macy's wins domain name dispute

E-mail Print

Macy’s Department Stores, Inc submitted a complaint to the National Arbitration Forum requesting three domain names to be transferred from the respondent to the complainant. Macy's was founded in 1858 by Rowland Hussey Macy and ever since it is known world wide.
Represented by CitizenHawk in this case, the company wants macya.com,macyc.com, and macyes.com to be transferred from the respondent to the complainant.
The company owns the registered trademark "Macy's",therefore they contended in the complaint that the three disputed domain names are confusingly similar to its trademark.
Moreover, they contended that the respondent,La Duzi ,registered and used the domain names in bad faith.
"Respondent’s <macya.com>, <macyc.com>, and <macyes.com> domain names resolve to websites featuring commercial search engines and hyperlinks relating to Complainant and Complainant’s competitors in the department store services business.  Complainant claims that Respondent’s use of the disputed domain names disrupts Complainant’s department services business because Internet users looking to buy products from Complainant may be redirected to Complainant’s competitors through Respondent’s confusingly similar disputed domain names. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed, the Panel decided the three disputed domain names to be transferred from the respondent to the complainant.
