MacNeil Lehrer Productions,a company co-owned by Jim Lehrer, Robert MacNeil, and Liberty Media has recently won a domain name through arbitration decision.
The company filed a complaint with the WIPO Arbitration and Mediation Center ,requesting the domain name pbsnewshour.org to be transferred from the respondent to the complainant.
PBS NewsHour is a television news program produced by MacNeil Lehrer Productions .They own the trademark registration for "PBS" .
Therefore,the company contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,the complainant contended that the respondent,Swallowlane Holdings,registered and used the domain name in bad faith.
"The Respondent is using the Domain Name to intentionally attempt to attract, for commercial gain, Internet users to its website or other online location, by creating a likelihood of confusion with MLP’s mark as to the source, sponsorship, affiliation, or endorsement of the respondent’s website or location or of a product or service on its website or location."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
