Louis Vuitton,the famous fashion house has recently won six domain names in Arbitration.
The disputed domain names are : louisvuitton-bag.com,3alouisvuitton.com,louisvuitton-eshop.com,louisvuitton-goods.com,lv-goods.com, and lv-lv.com
The fashion house submitted a complaint to the National Arbitration Forum,requesting the disputed domain names to be transferred from the respondent to the complainant.
Louis Vuitton owns many trademark registrations for the "Louis Vuitton" mark all over the world.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Respondent’s use of a confusingly similar domain name to divert Internet users to its website, where it sells counterfeit products of Complainant, creates a disruption in the business of Complainant."
"Respondent is using the confusingly similar domain names to attract Internet users to its website for commercial gain in bad faith. Complainant submits evidence that shows Respondent’s websites that resolve from the disputed domain names are displaying replica products of Complainant for sale. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain names to be transferred from the respondent to the complainant.
