Louis Vuitton,the famous fashion house has recently won the louisvuittoninfo.com domain name in Arbitration.
The fashion house submitted a complaint to the National Arbitration Forum,requesting the disputed domain name to be transferred from the respondent to the complainant.
Louis Vuitton owns many trademark registrations all over the world.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Respondent is using the confusingly similar domain name to attract Internet users to its website for commercial gain in bad faith. Complainant submits evidence that shows Respondent’s website that resolves from the disputed domain name is displaying replica products of Complainant for sale. Complainant contends that this use, in connection with the confusingly similar domain name is evidence of bad faith registration and use. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
