Intesa Sanpaolo,a banking group which has clear leadership in the Italian market and a strong international presence has submitted a complaint with WIPO Arbitration and Mediation Center requesting the transfer of bancaintesa.mobi domain name.
The company is the owner of the trade mark "Banca Intesa",therefore they contend that the disputed domain name is confusingly similar to its trademark.Moreover,it seems that the respondent,Xiaole Zhang,used the domain name without having any rights or legitimate interest.
He even had the domain name linked to a commercial link farm website offering links to websites of the Complainant’s competitors, or a domain name parking service .
Even though the disputed domain name resolves to a link farm website offering links to websites of the Complainant’s competitors,it seems that none of these links were active.Therefore the Panel found no evidence that the respondent used the disputed domain name to earn money using pay-per-click.
All in all,the Panel decided to order the transfer of the disputed domain name from the respondent to the complainant.
