Lacoste wins domain name case

Lacoste,am apparel company that sells high-end clothing,footwear,perfume and some other products filed with the WIPO Arbitration and Mediation Center two months ago,requesting the domain name,lacoste-shopping.com to be transfered to them.

It is well known that Lacoste has many registered trademarks for the term "Lacoste" all over the world.Because the respondent,China Bizseas,did not respond in any way,it's clear that the disputed domain name was registered in bad faith.

In an attempt to demonstrate that the domain name was confusingly similar to its trademark the company sais that "the domain name is confusingly similar to Lacoste" trademark,because it incorporates their famous trademark entirely."

Moreover,they continue "Given the reputation and renown of the trademark it is probable that a majority of Internet users who see the domain name will immediatly recognize the trademark,and assume that the domain is owned,controlled or endorsed by them."

The interesting thing in this case is that the respondent used the domain name in bad faith.He used the domain name to redirect people to a website,in which he sells dozens of varieties of couterfeit Lacoste merchandise.

Having established all three elements required ,the Panel ordered the domain name,lacoste-shopping.com to be transfered from the respondent to the compliant.
