Johnson & Johnson gets hands on ilovejohnsons.com domain name

Johnson & Johnson,the global American pharmaceutical, medical devices and consumer packaged goods manufacturer submitted a complaint to the National Arbitration Forum,requesting the domain name ilovejohnsons.com to be transferred from the respondent to the complainant. The company,represented in this case by Darren S. Cahr has many trademark registrations for the Johnson's mark.Therefore they contended in the comaplaint that the disputed domain name is confusingly similar to its trademark.
Moreover,Johnson & Johnson contended that the respondent,Po Ser ,registered and used the domain name in bad faith
"Respondent is using the <ilovejohnsons.com> domain name to display links to third-party, adult-oriented websites.  The Panel infers that Respondent was attempting to profit from this use.  Because the disputed domain name is confusingly similar to Complainant’s JOHNSON’S mark, Internet users are likely to be misled or confused as to Complainant’s association with the resolving website.  The Panel finds that Respondent was profiting from this confusion and therefore finds Respondent registered and used the disputed domain name in bad faith. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
