The British high fashion house,Jimmy Choo Ltd. ,has filed for arbitration to get the jimmy-choo-shop.com domain name .
Jimmy Choo Ltd.,represented by A.A.Thornton & Co ,filed a complaint with the WIPO Arbitration and Mediation Center requesting the domain name jimmy-choo-shop.com to be transferred from the respondent to the complainant.
The British high fashion house is the registered proprietor of the "Jimmy Choo" mark .Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent ,Zhang Linrui,registered and used the domain name in bad faith.
"The website at the disputed domain name offers for sale the Complainant’s branded products. Thus the disputed domain name is clearly being used in an attempt to catch Internet users searching for the Complainant’s products. Such use is likely to mislead consumers into believing that the Respondent’s website is associated with the Complainant. Consumers are likely to believe that they are purchasing authentic products through a website authorized by the Complainant."
Because the respondent failed to submit a response and because the complainant managed to demonstrate all the elements needed ,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
