Janet Jackson,the american recording artist and actress ,represented by Stephen J. Strauss just won a domain name dispute.
They submitted a complaint to the National Arbitration Forum,requesting the domain name rhythmnation1814.com to be transferred from the respondent to the complainant.
Janet Jackson released a record under the " Rhythm Nation 1814" mark and ,moreover,the same mark was used in a world concert tour,which was attended by two million people.
Therefore,Janet Jackson contended that the disputed domain name is identical with the Rhythm Nation 1814 mark.
Moreover,she also contended that the domain name was registered and used in bad faith by the respondent.
"Respondent has registered the <rhythmnation1814.com> domain name but has failed to make an active use of it over a period of five years. The Panel finds that such non-use constitutes bad faith registration and use."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements required,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
