Hermes International ,the well known French high fashion house has recently won HermesCopy.com domain name through arbitration.The fashion house submitted a complaint with the WIPO Arbitration and Mediation Center,asserting legal rights over the disputed domain name .
Hermes owns numerous trademark registration for the "Hermes" mark all over the world.Therefore,the company contended that the disputed domain name is confusingly similar to its trademark.Moreover,they contended that the respondent registered and used the disputed domain name in bad faith.
"The Respondent’s use of the Complainant’s mark to promote similar or identical goods to the goods being offered by the Complainant is clear evidence in the Panel’s view that the Respondent registered and is using the disputed domain name with knowledge of the Complainant and of the use the Complainant is making of its widely known HERMES trademark, and indicates that the Respondent’s primary intent with respect to the disputed domain name is to trade off the value of these."
The respondent,Yuanyuan Deng / Deng Yuan failed to submit a response in this proceeding.
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
