The company submitted a complaint to the WIPO Arbitration Center, asserting legal rights over the disputed domain names .
Hermes owns many trademark registrations for the "Hermes" mark all over the world. Therefore, they contended that the disputed domain name is confusingly similar to its trademark .
Moreover, they contended that the respondent registered and used the disputed domain names in bad faith :
"Respondent registered the Disputed Domain Names for the sole purpose of creating confusion with the Complainant's well-known HERMES trade mark and benefitting from this confusion by selling counterfeit Hermes bags."
The Panel ordered the two domain names to be transferred from the respondent to the complainant.
