Google wins mygooglemp3.com domain name in Arbitration

National Arbitration Forum announced that a ruling has been issued in favor of Google regarding rights to the Internet domain name mygooglemp3.com. Google,represented in this case by Meredith M. Pavia submitted a complaint to the National Arbitration Forum asserting legal rights to the disputed domain name.
The complainant owns many registration for the "Google" mark .Therefore,they contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Respondent failed to put forth any evidence of its intent to use the disputed domain name.  The disputed domain name remains constructively unutilized, displaying only a modified version of Complainant’s GOOGLE logo and an under construction message on the resolving website.  Accordingly, the Panel finds that the disputed domain name is not active and as such supports findings that Respondent registered and is using the disputed domain name in bad faith ."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements required,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
