Google , an American public corporation, earning revenue from advertising related to its Internet search, e-mail, online mapping and many others submitted a complaint to the National Arbitration Forum,requesting the domain name googlewebmarketing.com to be transferred to them .
Even though the disputed domain name has the descriptive phrase “web marketing",the Panel decided that the domain name is still confusingly similar to Google's trademark .
Moreover,the corporation contended that the domain name was registered and used in bad faith .
As noted in the complaint , "Complainant claims that Respondent has created a likelihood of confusion as to Complainant’s association or sponsorship of the disputed domain name, which was registered on May 19, 2008, for commercial gain due Respondent’s competing operation. The Panel agrees, and finds that Respondent has engaged in bad faith registration and use."
Because the respondent failed to submit a response and because the complainant managed to demonstrate all the elements required,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
