National Arbitration Forum announced that a ruling has been issued in favor of Google regarding rights to the Internet domain name googleceviri.net.
Google,represented in this case by Meredith M. Pavia submitted a complaint to the National Arbitration Forum asserting legal rights to the disputed domain name.
The complainant owns many registration for the "Google" mark .Therefore,they contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Respondent’s <googleceviri.net> domain name resolves to Respondent’s website which competes with Complainant. Internet users, specifically Internet users from Turkey, intending to utilize Complainant’s translation services, may instead use Respondent’s competing translation software because of Respondent’s use of the confusingly similar disputed domain name. "
"Respondent offered to sell the <googleceviri.net> domain name to Complainant for 1,500 Turkish Lira with an additional fee of 1,000 Lira. After Complainant offered to pay Respondent’s registration costs of 61 Lira, Respondent demanded 1,000,000 U.S. dollars. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements required,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
