Google wins Googlebooks.com domain name in arbitration

The National Arbitration Forum announced that a ruling has been issued in favor of Google regarding rights to the Internet domain name Googlebooks.com .Google,represented in this case by Meredith M. Pavia submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain name. Google owns many trademark registrations for the "Google" mark.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith.
"Respondent uses the disputed domain name to intentionally attract, for commercial gain, Internet users to its website by creating a likelihood of confusion with Complainant’s mark as to the source, sponsorship, affiliation, or endorsement of Respondent’s website. "
Because the complainant manged to demonstrate all the elements needed and because the respondent failed to submit a response in this proceeding ,the Panel ordered the disputed domain name be transferred from the respondent to the complainant.
