"Respondent is attempting to commercially benefit by creating confusion among Internet users as to Complainant’s affiliation with the domain name. Internet users will become confused as to Complainant’s affiliation with the disputed domain name because the domain name is confusingly similar to Complainant’s GMAIL mark. Respondent capitalizes on this confusion when it receives personal information, sales of text messaging plans, and the download of the adware toolbar. "
The Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
