An arbitrator with National Arbitration Forum has awarded the domain name GoogleFinanceAlerts.com to Google.All started when Google submitted a complaint to the National Arbitration Forum.requesting rights over the disputed domain name.
Google owns many trademark registrations for the "Google" mark.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith.
"Respondent uses the disputed domain name to misdirect Internet users who are seeking Complainant’s official website to its own site on which it displays Complainant’s mark and offers services that compete with Complainant. Respondent likely receives a commercial benefit from this creation of confusion, as Internet users are likely to misunderstand a connection or sponsorship by Complainant regarding Respondent’s <googlefinancealerts.com> domain name."
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
