The National Arbitration Forum announced that a ruling has been issued in favor of Google regarding rights to the Internet domain name googuia.com.
Google,represented in this case by Maria F. Castellanos submitted a complaint to the National Arbitration Forum asserting legal rights to the disputed domain name.
The complainant owns many registration for the "Google" mark .Therefore,they contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Respondent’s current use of the Domain Name to resolve to a website that imitates Complainant’s website constitutes bad faith registration and use. "
"Respondent is using the disputed domain name in order to intentionally attract Internet users to its website by creating a strong possibility of confusion with Complainant’s GOOGLE mark. Respondent offers search engine services in direct competition with Complainant, which is further evidence of bad faith."
Rulling in Google's favour ,National Arbitration Forum arbitrator Houston Putnam Lowry ordered the disputed domain name to be transferred from the respondent to the complainant.
