Google,the American public corporation,earning revenue from advertising and many others,has recently won a domain name dispute .
The corporation submitted a complaint to the National Arbitration Forum,requesting the domain name googlemapsrealestate.com to be transferred from the respondent to the complainant.
Complainant is the owner of the "Google" mark,registered with the United States Patent and Trademark Office.
Therefore,they contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith.
"Respondent is using the <googlemapsrealestate.com> domain name to host a website that imitates Complainant’s Google Maps” website, and which offers the same services that Complainant offers at its “Google Maps” website. Complainant also contends that this diversion of Internet users to Respondent’s competing business is an intentional disruption of Complainant’s business by Respondent."
"Respondent is gaining commercially by profiting from selling its competing services, and that these sales are evidence of Respondent’s bad faith registration and use of the <googlemapsrealestate.com> domain name ."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
