Google,the American public corporation,has lrecently won a domain name dispute .
Google submitted a complaint to the National Arbitration Forum,requesting the domain name googleos.org to be transferred from the respondent to the complainant.
It is well known that Google owns many trademark registrations with the United States Patent and Trademark Office for the "Google" mark.Therefore,they contended in the complaint that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent ,Aloysius Thevarajah ,registered and used the domain name in bad faith.
"The record indicates that the <googleos.org> domain name resolves to a parked website that features hyperlinks to third-parties unrelated to Complainant. The Panel assumes that Respondent receives click-through fees from the aforementioned hyperlinks. Moreover, it is likely that Internet users may become confused as to Complainant’s sponsorship of or association with the disputed domain name and resolving website. Respondent undoubtedly profits from this confusion. This use of the disputed domain name constitutes bad faith registration and use ."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the domain name be transferred from the respondent to the complainant.
