Google gets hands on four domain names

E-mail Print

Google, the American public corporation, earning revenue from advertising and many others, has recently won four domain names cases. The public corporation submitted four complaints to the National Arbitration Forum, requesting the domain names googlemark.org,googlemenu.com,googlemarketing101.com and googlesearchserver.net to be transferred from the respondent to the complainant.
It is well known that Google owns many trademark registrations for the "Google" word all over the world. Therefore,Google contended that all four domain names are confusingly similar to its trademark.
Moreover, the complaint contended that the respondents registered and used the domain names in bad faith.
For example,in the googlemarketing101.com domain name case,Google accused the respondent ,Joel Goldstein,of "using the <googlemarketing101.com> domain name to redirect Internet users searching for Complainant to its own directly competing website.  When Internet users type in Complainant’s mark, they would reasonably expect to be directed to Complainant’s website offering Complainant’s services.  When Respondent’s website appears instead, Internet users are likely to become confused as to Complainant’s sponsorship or affiliation with the disputed domain name and resulting website.  Respondent is attempting to profit from this confusion."
In all four cases the Panel ordered the disputed domain names to be transferred from the respondent to the complainant.
