A World Intellectual Property Organization (WIPO) panel has again ruled in favor of famous trademarks, holding that a domain name incorporating a famous trademark and a generic term separated by a hyphen constitutes trademark infringement because the domain name is confusingly similar to the famous trademark.

In AtlasCopco v. AtlasCopcoiran.com, et al. a Virginia District court held that under section 1125(d)(2)(A) of the Anticybersquatting Consumer Protection Act (ACPA), a court can exercise authority over an entity, rather an individual. They can assert this type of jurisdictional standard, known as rem jurisdiction, to cyber squatters located in foreign countries as long as the plaintiff can confirm the following:

With the .ASIA domain landrush in late February of this year and the 2006 launch of the .EU extension, there begs room for speculation if a .AFRICA extension will ever be created. The odds are not in favor of it based on the current economic and humanitarian crises troubling the African continent. Don’t be caught putting all your eggs in one basket any time soon.

Last year, the excitement around the new .Asia TLD launch in June was followed by an announcement that Pool.com would act as the exclusive auction partner for the .Asia Registry during the sunrise (launch) period.

It is now being reported that "Lucky Rich" Richard Schreier, CEO of dotasia-auctioneer Pool.com seems to have won many top-domains for himself in those .asia auctions, by using bidding parties camouflaged as third party companies, but ultimately owned by Richard Schreier.

It is indeed odd that premium .asia domains, which can be worth millions, such as porn.asia, dating.asia, insurance.asia, lotto.asia, stocks.asia, auction.asia, beer.asia, fitness.asia, girls.asia, wine.asia ended up in the hands of the CEO of the "exclusive auction partner for the .Asia registry".

So far, complaints sent to Mr. Edmon Chung, CEO of dotasia indicate that he doesn't seem to have any issues with this. His answer to these allegations can be read below...

At the request of ICANN, Paul E. Black, a computer scientist at the National Institute of Standards and Technology (NIST) has developed an algorithm that may guide applicants in proposing new top-level domains. As new top-level domains are added to the familiar .com, .info, and .net, the algorithm will check whether the newly proposed name is confusingly similar to existing ones by looking for visual likenesses in its appearance...
